Freshfields recommends agreeing AI rules at the start of German arbitration
A new Freshfields analysis argues that existing German law already limits AI use in arbitration.
The 5 October publication stresses personal decision-making by arbitrators, counsel’s responsibility for submissions and confidentiality. It recommends recording permitted AI uses, disclosure and data safeguards in the first procedural order. This is the authors’ legal analysis, not newly enacted legislation. For practitioners, its central proposal is to agree boundaries early rather than leave AI use unresolved until an award is challenged.
